What Typically Occurs in Workers’ Compensation Cases in Charleston
Typically, what happens in these cases is that somebody gets injured on the job. Either they think the injury is going to be minor, and they try to shake it off or they hope against hope that the problem is going to go away. In that type of case, typically, it takes several weeks or even several months later until that the client contacts a lawyer. This first contact typically coincides with when they realize that the injury is not going away and that the problem is going to persist. Usually, either they are getting some cooperation from the employer by sending them to a doctor, but the doctor is not the one they would like or the employer is not cooperating at all and tells them that finding a doctor and paying for a doctor is their own responsibility.
The second way these cases could play out is when there is a clear accident involving a broken bone, a bone protruding through the skin, or some type of trauma that requires emergency medical services. A lot of times in those cases, lawyers receive contact from the hospital or from a relative. Those are the two situations in which lawyers are contacted by clients, typically.
The First Meeting with the Charleston Workers’ Compensation Client
In that particular case, the client contacted this firm quickly. The injured worker had been in the motor vehicle accident, had been taken by emergency medical services to the hospital, and the wife had contacted our law firm. Within 48 hours of the accident, we were able to meet with the injured worker in the hospital and get all the necessary paperwork signed to start the case. We began our investigation immediately. This is important because the sooner lawyers can get involved, the sooner they are able to develop and preserve evidence at the scene of the accident which could help prove both the liability of the at-fault party and the damages that resulted. In that particular instance, the injured worker was very fortunate that his wife reached out early before some of the evidence disappeared, memories faded, or the vehicle had been destroyed.
Speaking to the Opposition
We reached out to the opposing party without hesitation. The first thing we do after meeting with a client is to toll the statute of limitations with the appropriate agencies. In that previous case, the Workers’ Compensation Commission and the Department of Labor were the appropriate agencies because there was a concurrent jurisdiction claim with the Longshore Harbor Workers’ Compensation Act and with the State Workers’ Compensation Act. We reached out to let the insurance companies know that the injuries were serious and that they needed to account for these injuries.
Let an Attorney Help
Our client was able to eventually reach a settlement with the wrongdoers and employers involved with their workers’ compensation claim. However, the client would not have been able to reach the settlement amount they needed without the help of an experienced attorney.
