Comedian Tracy Morgan, James McNair who was also a passenger was killed and Morgan as well as several other passengers were injured when a Walmart truck struck their limousine in June. Now, in response to a lawsuit filed by Morgan and the others; Walmart Stores Inc. claims the injuries were “in whole or in part” because of the passengers in the limo “failure to properly wear an appropriate available seatbelt restraint device.”

I’m very upset, not for myself but for the families I represent.” Criminal charges have also been filed against the truck driver who was behind the wheel at the time of the crash. He pleaded not guilty to all charges.
