Student In School Play Is Stabbed By Prop Used In Play

An innocent accident during a school play resulted in a student being stabbed by another student.

The Caldwell Academy, a Christian school in Greensboro, was hosting the play “The Three Musketeers”, when one of the students accidentally stabbed another student with a prop used in the play.  The injured student was not seriously injured and should make a full recovery.

Accidents usually happen because someone was careless.  If there is an instance where two or more people are in an accident and more than one person was careless, the person who was the least careful is responsible for paying at least some of the damages suffered by the people that were more careful.  Most legal liability is determined in this manner.

If you have been injured in an accident, it is important to speak to someone that understands the laws that surround legal liability.  It is not enough to think or say it was someone else’s fault.  You must be able to prove that someone was careless when they should not have been and because of their carelessness, you were injured.  That is establishing “negligence”, which establishes legal liability.

In this case, an experienced lawyer would look at the liability of the school as well as the liability of the students involved.   If an accident occurs on property that has not taken care to avoid injuries from occurring, the school could be held liable for the injury to the student.

Sometimes, your own carelessness affects your claim.  South Carolina is a comparative negligence state.  This means that if you were partially responsible for an accident, it could affect the amount of recovery you are eligible when recovering for your injuries.  Because comparative negligence laws vary from state to state, it is important to speak to someone that understands these laws in the state you live, or the state where the accident occurred.
